The other big story we're following ... is a local father who was arrested for not paying thousands of dollars in child support. But says the person who ordered his arrest, didn't have the AUTHORITY to do so. That's why he's teamed up with an attorney to get him out of jail. Today, they talked to Channel 4's Jim Piggott--- who is joining us now live from the courthouse, downtown. Jim, exactly WHO ordered his arrest? 3 3 he says it was a hearing officer who ordered him to jail..the records say it was a judge.. but the problem is the judges order is dated long after his arrest 3 00-0616-2238-441.20-1.27 Brian Lucynski admits he owes 20 thousand in back child support for his four kids. He says he was paying it though work, but for some unknown reason they stopped withholding it.. without his knowledge .. and then when he went to court last month to show them what happen. He ended up in jailI tried to pled my case and they told me that was a bunch of baloney and that was pretty much it and then all the sudden I have two guys at my back putting handcuffs on me. But Luczynski and his attorney say it was not a judge who ordered him to jail.It was a hearing officer.. and Attorney Neil Weinreb says that's not legalthey are just turning around essentially to the officers in the courtroom and incarcerate this man and in my opinion it amounts to a false arrest Luczynski says he spent three days in Jail and then hired his attorney. Weinreb went to the judge who according to this document immediatly ordered his release. They are incarerating people immediately before a judge even has a recommendation. We checked the documents in the case .. and found that dates don't match up. this is the order from the hearing officer saying luczynski should be arrested. its dated april 21, but the Judge did not sign the order for his arrest until May 9th ..19 days after he was arrested I talked to court officials about this case and they told me they really don't know the background on this but they did say a hearing officer cannot order the arrest of someone. It has to come from a judge Weinreb says he is trying to get things changed and believes it will happen by pointing this out I think it's a lawyers duty as an officer of the court to make sure the courts are respecting the law the way they are suppose to. 3 The hearing officers are appointed by the court here.. but are paid by the Department of revenue .. I contacted them. and they were not aware of this.. and say there staff does not have arrest powers ..but they are not involved with hearing officers 3 Jim, did you get a chance to speak with the judge who signed the release?
