Man Faces 2 Trials In Boy's Shooting Death

Judge Denies Motions To Suppress Police Interview

A man accused of furnishing a handgun to a 12-year-old who investigators said later shot himself in the head will have two trials on the charges, a judge decided on Thursday.

Derrick Glover's trial on charges of manslaughter and furnishing a firearm to minor is scheduled to begin on Monday. The following Monday he will go on trial on two counts of possession of a firearm or concealed weapon by a juvenile found to have committed a felony.

Glover's charges result from the July 2007 death of Tony Youmans, a Westside middle-school student found dead in the woods near his house two days after he was reported missing.

While police and prosecutors will not talk about the case, court papers show a friend was with Youmans when he shot himself in the head shortly after buying a handgun from Glover. It was never clear if the shooting was accidental or on purpose.

Glover was arrested the day the body was found and ordered held without bond.

His wife says he's innocent.

"I don't know why everybody's lying, saying that he did something he did not do," said Glover's wife, Lisa Dasher. "He loves kids. He would not give no child no gun."

In Glover's final pre-trial hearing, Circuit Judge Charles Arnold refused to throw out the defendant's initial interview with detectives. Defense lawyers claim the interview violated Glover's rights.

"When viewed within context, the statements the Defendant made and the questions he asked during the interview were not directed to a lack of understanding of his rights or an indication he wished to invoke his right to remain silent," Arnold wrote in denying the motion to suppress.

In addition to deciding to hold two separate trials on the charges, Arnold also denied a defense motion to recuse himself from hearing the case.
