Apartments In Foreclosure; Tenants Suffer

POSTED: Thursday, May 1, 2008

For some Jacksonville renters, their landlord's financial troubles have been causing them some serious problems at home.

The tenants who live in the San Juan Gardens Apartments on the Westside spoke out Thursday afternoon, claiming they were forced to spend most of the previous day without running water.

"How am I going to flush my toilet? How am I going to take a shower? It's just crazy," said resident Gregory Streety.

While the water has been turned back on, renters still said they have more problems and a long list on complaints against the property owner, Jeffery Daniel.

All tenants of the apartment complex recently received a notice of foreclosure.

According to the documents, Daniel owes the bank more than $179,000 and his last mortgage payment was made in December of 2007.

"From day to day, we don’t know what and when we're going to have to get out and leave or what we're going to be doing," said resident Gwen Hatton.

She said it was Daniel's negligence in paying their water bills that forced JEA to shut of the water for several hours until the outstanding bill was paid.

Tenants also told Channel 4 that necessary maintenance has not been done.

"It makes you question, do you trust your private owner? When you're paying your rent every month, you expect more. You expect repairs to be done in a timely manner," said tenant Tammie Noisette.

According to the city of Jacksonville code enforcement records, maintenance problems have been reported in three different units at San Jun Gardens.

One unit inspected in January was found to have a hole in the ceiling, chipping paint and old and deteriorating stove burners. According to the city, when they returned to the same unit in April nothing had changed.

Channel 4 attempted to contact Daniel through his lawyer and on his cell phone, however the phone calls went unanswered and Daniel's voice mailbox was full.

Tenants said they've been unable to reach their landlord. They said they've been working with Legal Aide to get their deposit money back and move out of the deteriorating complex.
