High Court Clears Way For Death Penalty To Resume

TALLAHASSEE, Fla. -- Within hours of the U.S. Supreme Court lifting a stay of execution of a man convicted of killing an 11-year-old boy, Gov. Charlie Crist ordered that the sentence be carried out at 6 p.m. on July 1.
Mark Dean Schwab was given a reprieve while the justices considered the constitutionality of lethal injection procedures in several states.
The court a month ago upheld the use of lethal injection in a similar Kentucky case. On Monday, they lifted the stay on Schwab's execution that was ordered six months ago.
Schwab hd been scheduled to be executed in November for raping and murdering Junny Rios-Martinez in 1991.
"Our thoughts and prayers are with the Rios-Martinez family as they move one step closer toward seeing justice finally obtained for Junny Rios-Martinez," Attorney General Bill McCollum said in a statement issued Monday.
