Amendment #2 - Florida Marriage Protection Amendment

POSTED: Thursday, October 9, 2008

Official Ballot Summary: This amendment protects marriage as the legal union of only one man and one woman as husband and wife and provides that no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized.

This amendment has been called the Marriage Protection Amendment.

Not only would it define legally valid ?marriage? only as the union between one man and one woman, but it would enshrine that designation in the State Constitution.

This amendment would outlaw legal recognition of all other partnerships, including opposite-sex and same-sex partners. It would block legal, health and/or economic benefits to any couple that is not a married man and woman.

This is the only amendment put on the ballot by a citizens? petition. The sponsor of the petition drive is an Orlando lawyer who heads a religious conservative group.

A Florida statute currently stipulates that only man-woman marriage is legal.

Enshrining Amendment 2 in the state Constitution would prevent a court challenge from overturning that statute.

What It Means

A "YES" vote means: You support adding ?man-woman marriage only? to the state constitution

A "NO" vote means: You favor no action
