JACKSONVILLE, Fla. -- The son of a man killed in a collision with a Jacksonville Sheriff's Office police cruiser said he is appalled to learn that the officer who hit his father was speeding in an attempt to catch a car with tinted windows.
The fatal crash happened on Jan. 14. That's when the Florida Highway Patrol says the officer, 29-year-old Marcus Kilpatrick, was trying to catch a driver for a traffic violation on Merrill Road when his patrol car collided with 86-year-old Matthew Ogden's pickup truck.
Ogden died at the scene. Kilpatrick suffered minor injuries.
The FHP has been investigating the crash. Investigators recently announced that the officer was going 98 mph in a 40 mph zone while trying to catch up with a car to check its tinted windows when he struck Ogden's truck.
"It's appalling," said Douglas Berreth, Ogden's stepson.
Berreth knew the officer was speeding after a traffic violator when the officer's cruiser slammed into his dad's car. However, he recently learned that according to the FHP, the officer was trying to catch someone driving a car with tinted windows.
"I feel that it created a death and it should not have happened in that manner, and I do not believe total safety was the concern when the officer was in pursuit," said Berreth.
Kilpatrick was driving a marked JSO patrol car and Ogden was in a blue pickup truck on the day of the fatal crash. The officer was traveling at a rate of speed more than double the posted limit on Merrill Road when Ogden turned his truck left in front of Kilpatrick.
"He was in a school district and residential area, and 98 mph is totally unacceptable for any reason," Berreth said.
There have been conflicting reports about whether the officer had his lights and siren on at the time of the crash, but the FHP said there is no dispute about the speed or the reason.
In Orlando, officers will not give chase because of a traffic violation. The same is true for St Johns County. In Nassau County, it's up to the officer involved. Each agency said safety is its first priority.
"I hope we can find closure for the family and the citizens of Jacksonville so an accident like this will never happen again," Berreth said.
The FHP's investigation into the crash is ongoing.
