UPDATED: 4:29 pm EDT August 5, 2009

Police said a crash Tuesday on the Southside was no accident.

They arrested Devarus Peterson Wednesday.

He was driving a black BMW.

Investigators said he got into a fight with his girlfriend Brittany Mack, chased her down the street and eventually ran her off the road on the 2100 block of Leon Road.

"Peterson has been arrested on two counts of aggravated battery," Lt. Larry Schmitt said.

"Could be upgraded to an attempted murder charge."

Mack was in the car along with the couple's 1-year-old daughter.

Leon Road wreck
A car went airborne and landed on a parked SUV in a driveway on Leon Road.
The car flipped and landed upside down.

Both Mack and the baby were ejected from the car.

Police also said the baby was not in a car seat.

Now, the mother and baby are in the hospital, and Peterson is in jail.
