Jury Awards $5.1 Million In Palm Coast Wreck

Flagler County Wife Killed, Husband Injured By Sod Truck

A Flagler County jury hearing the wrongful-death lawsuit against a sod company and its diver over a 2006 wreck that killed a woman and seriously injured her husband returned a $5.1 million judgment.

Ingrid Falkenstein, 67, was killed when a fully loaded tractor-trailer carrying a load of sod ran a stop sign at Cody's Corner, in southwestern Flagler County, on May 18, 2006. Her husband, David Falkenstein, recovered from his injuries.

The driver blamed bad signage and failing to replace rumble strips leading up to the stop sign, but the jury's verdict reached late Thursday placed 60 percent of the blame on the driver, 40 percent on the company and none on the county.

The Falkensteins’ attorney, Steve Pajcic, argued that reckless driving by a tired trucker had robbed the Falkensteins of their golden years of retirement that they had earned by hard work and 33 years of devotion to family.
