Jury Recommends Death For Rasheem

3 Brothers Convicted Of 2006 Murder Of 8-Year-Old Girl

A jury has recommended the death penalty for Rasheem Dubose, the third of three brothers convicted of killing an 8-year-old girl in 2006.

After two days of testimony in the sentencing phase and an afternoon of arguments by lawyers on both sides, the jury took just more than an hour to reach an 8-4 verdict.

With his two younger brothers already sentenced to life in prison for the crime, attorneys for Dubose, 25, tried to convince the jury the eldest brother should not receive the death penalty for the shooting death of Dreshawna Davis.

  Dreshawna was an honor roll student about to begin the fourth grade at Lola Culver Elementary School. She was killed two weeks before her 9th birthday. 
After the recommendation of death was read Thursday evening, Rasheem Dubose kicked over his chair and was led from the courtroom. The Dubose family left the courtroom in tears.

Both Dreshawna's grandmothers held hands with those around her as the recommendation was read.

"I'm just very grateful; I'm well satisfied with the verdict," said Vonnie Frasier, who was in the house with her granddaughter when the shots were fired. "I feel that death is truly deserved."

"It was a long case, and I truly miss Dreshawna," said Carlas Washington, the victim's paternal grandmother. "I think about her everyday. She's in my heart."

All three brothers were convicted earlier this year of first-degree murder and firing into an occupied dwelling in the killing of Dreshawna, who was killed when 29 shot were fired into her grandmother's home in July 2006.

Prosecutors called the shooting a retaliatory strike targeting Dreshawna's uncle, who had robbed and humiliated Rasheem Dubose earlier that day.

Last Friday, a jury recommended life sentences for Tajuan and Terrell Dubose. Judge Page Haddock immediately sentenced Tajuan, 21, to life in prison without possibility of parole, then did the same on Monday for Terrell, 23.

The recommendation of death for Rasheem Dubose will be taken under advisement by Judge Page Haddock. The actual sentencing is scheduled for April 23.

On the first day of the sentencing hearing, the Dubose brothers' grandmother was removed from the courtroom after prosecutors complained she had been speaking with other witnesses, which is forbidden.

After prosecutors reminded jurors of the facts of the case -- including the fact that the fatal shot was fired by Rasheem's gun -- and listed reasons Rasheem Dubose qualifies for the death penalty under Florida law. Then the defense team then called series of witnesses they said would to explain, not excuse, his actions.
