Good evening. Marissa Alexander will soon be back in Duval County, closer to her family.. She's been serving time in a state facility after she was sentenced under the "10-20-life" law...for firing a gun in her home... Prosecutors say she was endangering her family, but she says she was acting in self-defense. Channel 4's Hailey Winslow spoke with Alexander's attorney and is joining us live from the courthouse with the latest on her case, Hailey? 3 3 Marissa Alexander's attorney says she will be back in Duval County within a couple weeks... And then he plans to file a motion for a bond to be set as she waits for a new trial. 3 13 minutes...That's how long it took a jury to convict Marrisa Alexander on 3 counts of aggravated armed assault... She was sentenced to 20 years in prison...and has been spending it at the women's state prison in Marion County...In 2010, investigators say Alexander and her husband Rico Gray got into a heated argument ensued over pictures of their newborn baby she had sent to her ex- husband.Alexander says when Gray came at her and pushed her, she went to the garage, but couldn't get the door open. so she grabbed her gun, went back inside , and ultimately fired a warning shot into the wall...detectives say in the direction of Gray and her kids......Leaders of the social justice organization Florida New Majority are pushing for State Attorney Angela Corey to drop the charges saying Alexander was protecting herself and that Gray is a admitted abuser.In a statement from the state attorney's office, the director of communications says "the state attorney's office has no intention of dropping the charges. The SAO will continue to pursue justice for our two child victims and their father who were endangered by the shot the defendant fired at them."Last month, an appeals court granted Alexander a new trial saying the judge committed fundamental error in jury instructions...by transferring the burden of proof that she fired in self-defense from the state to Alexander. 3 Alexander's attorney says it's been extremely difficult for her to be away from her kids and she's hoping to be able to see them again soon. So Hailey, what's next for this case in court?Right now, a hearing is set for the end of the month...and we could see a possible bond set for Alexander in the coming weeks.
