3 Marissa Alexander will remain free on bond while she awaits her new trial for aggravated assault ..However, the judge who issued that ruling made clear he was displeased with a home detention supervisor. Alexander .. who is charged with firing a shot during a dispute with her estranged husband ..is on home detention. The state attorney wanted her back in jail for violating terms of that detention. Channel 4's Kumasi Aaron is covering this widely watched criminal case and is joining us LIVE from the courthouse with this new development, Kumasi. 3 Marissa Alexander didn't say anything during the hearing today.Instead her attorneys and the woman who gave Alexander permission to travel explained how they didn't believe they were violating the judges order. This is not a rule for violation.With those words from Judge James Daniel Marissa Alexander learned that she'd be able to leave this courtroom and go back home.The state attorneys office asked for her bond to be changed or revoked all because this woman, Alexander's pretrial release counselor April Wilson approved her trips, instead of the court as outlined in the judges order.Its an order Wilson said she believed she was following.APRIL WILSON/COMM UNITY TRANSITIONS CENTER 08:39:32-39 I've had many court orders and every time I read them I interpret them and this is the first time that I've ever been questioned.The 18 year employee of the Jacksonville a sheriffs office, Wilson told the court she treated Alexander's case like any other.And Alexander's defense attorneys showed the court papers Alexander signed on the first day she met with Wilson, stating pretrial services authority to authorize travel.APRIL WILSON/COMMUNITY TRANSITIONS CENTER 08:38:27-35 I make the judgement call on whether she could leave or not every time she would call I would go over the court order to make sure. But Judge Daniel countered, saying his order trumps any agreement with pretrial servicesJUDGE DANIEL 08:38:43-49 Is there anything in my order which grants you the ability or authority to make judgement calls?State Attorneys Office argued that Alexander knew the rules and was taking advantage of the court, trying not to be discovered.In fact Alexander's attorneys told the court they had no idea about the travel requests until the State Attorneys office began investigating in December. We are conducting an administrative investigation, and any necessary corrective action will be taken. 3 So the attorneys on both sides of this case will be back here in the courtroom on February 5th.They'll be going over scheduling and other issues. Alexander's trial is still scheduled for the end of March.
