3 Day 3 .. and the first full day of testimony in the murder trial of 18 year old De'Marquise Elkins .. in the killing of a Brunswick baby. One of the state's witnesses .. a police detective who responded to the shooting back in March. Elkins is charged with firing a single bullet .. hitting Antonio Santiago between the eyes as the child sat in his stroller. Channel 4's Tim Pulliam is covering the trial .. and is joining us live from the Cobb County courthouse in Marietta. Tim .. tell us first about the defense attorney's cross examination of this detective .. I hear it lasted for hours. 3 3 3 Sometimes it was difficult to understand where the defense was going with their questioning of the officer But overall it appeared they were trying to prove that police rushed to make an arrest without exploring other possible motives. Brunswick Police officer Angela Smith was on the stand today.The detective was one of the first to respond to the March 21st shooting that killed 13 month old Antonio Santiago and wounded his mother, Sherry West.4427-38 Gough: Did you not testify yesterday that the whole thing seemed bizarre to you? Smith: I have a 13 month old baby shot it was hard to believe anybody would do that..Smith testified that West was considered somewhat of a suspect at the time of the shooting.4525-33 Gough: What part of you standard operating procedure does it say you consider someone a suspect? Smith: There isn't Mr. Gough but one would have to assume while you're working the case to start with who you have in front of you.But Defense attorney Kevin Gough argued that police did not investigate Sherry West thoroughly before arresting and charging De'Marquise Elkins.015259-19 Gough: What steps did you take to to ensure that she's not responsible for the killing of her child? Smith: Just the interview with ms west. Gough: And what steps did you take to ensure Louis Santiago didn't have anything to do with it. Smith: I spoke with Mr. Santiago very briefly and that was it.Gough said police rushed to make an arrest because of the public outcry -- when there where no witnesses of the shooting except Ms.West.Today in court, Smith testified that after the shooting, when she met with West, she had some difficulty identifying Elkins in photo lineup 011523-50 Gough: In your presence in that room.She said the shooter was looking down alot and tough to see his face. Well if the day before the shooting she was looking down a lot and tough to see his face. Why did you have her sign an identification saying she was certain? Smith: Because she did advise that she was able to see his face. She said it was tough but she was able to see his face. The defense also tried to discredit Sherry West's ability to identify the suspects, claiming she suffers from PTSD, paranoia and bi-polar disorder ..The detective testified that she was aware that West has a mental disorder--but it didn't raise any red flags. 3 Tim, how are the jurors responding to testimony?
