3 The other big story we're following ... A custody battle that begins in Clay County, but expands across our nation's border. A mother, who deputies say, failed to protect one of her daughters from being sexually molested, is now fighting to keep BOTH of her girls in the United States and away from their father, in Mexico. Right now, the girls are living in a foster home. Channel 4's Tarik Minor was inside the courtroom for this custody battle and joins us live. Yes.This family counselor told the judge today, that the girls need to be with immediate family. Lawyers say the father is taking all the appropriate steps to gain full custody. Defense Attorney Carole Vogel says the Department of Children and Families, hasn't yet fully determined if all of the childdrens' emotional and physical needs will be met in another country.14:43:22"at this point we don't have a clear picture of what triggers it would take to return the children, how long it will take, what would happen if something happened, in a fathers home, would they be in an orphanage, on a street corner." The girls father testified by phone today, with the assistance of a translator.
