Police have released surveillance video of the Jaguars top NFL draft pick, Justin Blackmon, who was arrested earlier this month in Oklahoma on a DUI charge.
The video shows the rookie wide receiver being escorted into the Stillwater, Okla., jail with his hands behind his back and wearing a No. 8 Kobe Bryant Los Angeles Lakers jersey.
"Clearly, he's having some problems answering questions and simple things," Jacksonville attorney David Robbins said. "People would look at the video and say, 'Yes, he might be under the influence of alcohol.'"
Police arrested the first round draft pick and Oklahoma State star receiver after officers said he was driving a white Chevy Tahoe 25 mph over the speed limit on the wrong side of the road.
Robbins, who tries a lot of DUI cases in Duval County, said Blackmon may be able to get out of the DUI charge if police used the Intoxilyzer 8000, the same breath alcohol tester used in Florida.
"There are a lot of people in this community, both defense lawyers, prosecutors, judges, who feel the Intoxilyzer is a very flawed machine," Robbins said. "So whether he's got a chance or not, I don't know. I haven't looked at everything, but certainly if it's just based on a breath test, yes."
Robbins said the bottom line is Blackmon has had a previous problem with alcohol, and he needs to clean up his life before it affects his game.
"What I'm afraid for him as a person and then that bleeds over into the city and then the team is he's going to be arrested again, and if he doesn't confront this head-on as a life-long issue, he's not going to make it," Robbins said.
