Accused child killer's mother to tape testimony

Donald Smith is charged with murdering 8-year-old Cherish Perrywinkle

JACKSONVILLE, Fla. – The mother of the man accused of kidnapping, raping and murdering 8-year-old Cherish Perrywinkle will be allowed to videotape her testimony for Donald Smith's trial, a judge ruled Tuesday.

The state filed a motion to videotape Patricia Moore's testimony, because prosecutors want to preserve her testimony because of her age. She is 76.

The defense objected, saying Moore has no health issues.

Donald Smith's next pretrial hearing is scheduled for July 2.
