Investigators said that Gianna was in violation of Florida traffic laws when she suddenly entered the path of a vehicle too late for the driver to yield. Therefore there were no charges filed against the driver.

In the days and weeks after her death, her family and the Fleming Island High School community planted a tree near the intersection to honor Gianna.
