FLEMING ISLAND, Fla. – Parents living inside a gated community in Fleming Island said Monday they are beyond being upset at a neighbor.
They told deputies he committed an indecent act in front of children. But they’re concerned because he has not been arrested.
News4Jax has chosen not to identify the man because he has not been charged with a crime.
Three weeks ago, Tiffany Castillo said that she was outside with her children when her neighbor began to put on a lewd show from his bedroom window.
"There was a man standing there with his shirt up to here and everything exposed. I looked and he waived at me and did a motion," Castillo said.
News4Jax spoke to the man on Monday at his doorway.
“That’s entirely wrong and I have no comment about anything," the man said.
Castillo filed a complaint with the Sheriff's Office, but no arrest was made. She said a deputy told her that the best thing she could do was warn other parents, which she did.
But last week, Castillo said, the same man showed up at the neighborhood splash park. She said some parents got so upset they grabbed their children and left.
“The man sat right there in the pavilion, right directly behind the splash park, looking at the kids, had his camera like this," she said.
The man denied that allegation.
“I was not taking photos of anything or anyone. I have a right to go to that park," he said.
Other neighbors also said they're concerned about the allegations because the man's back window overlooks a jogging path.
“I’m worried about the females that jog back there. I’m worried about the little kids because his window faces the kid’s park and the pool," said parent Felipe Castillo.
Many neighbors have begun posting photos of the man on social media. When News4Jax asked him about that, he said that his neighbors have no images of him taking photos of children.
According to state law, to convict someone for a lewd act related to incident exposure, prosecutors would have to establish an unlawful intent. Without intent, it becomes hard to prove a defendant acted in a lewd manner.
The Sheriff's Office said this is an ongoing investigation.
