JACKSONVILLE, Fla. – The last two years have been terrible for Shannel Mett, who's had to spend them mourning the loss of her son Kaylum Frank.
Investigators said 12-year-old Kaylum was crossing Blanding Boulevard at Westconnet Road with his brother about 6:30 p.m. two years ago when he was run over by a SUV. Kaylum died. His brother, who saw it all, wasn't hurt physically, but was scarred for life emotionally.
"No matter what I do, I can never take the pain away of what they saw and living without their brother," Mett said. "I have to live every day with my kids hurting, and I can't fix it."
A Jacksonville Sheriff's Office crash report identified the driver of the SUV that hit Kaylum as a 33-year-old woman. A toxicology report showed she had alcohol, THC and Valium in her system at the time. But detectives said she was not over the legal limit and the substances in her blood didn't cause impairment.
After checking with the state attorney's office, police decided to not charge the woman in the crash.
The woman did not return requests for comment Wednesday, and because she is not facing charges, Channel 4 is protecting her identity.
Two years later, Kaylum's family is still torn up about the crash that took the life of the boy who seemed to never stop smiling. The family said they're still asking for justice.
"She was on Valium, had marijuana in her system and admitted to having a drink," said "Her story changed on each interview -- that was documented. I feel like there should have been something. But she got nothing."
Family and friends gathered Wednesday evening for a balloon release to remember Kaylum.
A Facebook page has been created for a charity in the 12-year-old's honor called Kaylum's Gift. The organization helps buy art supplies for hospitalized children locally.
