In March 2012, Swearingen, Richard Haddon and two others were hanging out at the Pirate's Cove beach area off of Heckscher Drive. During that time, Swearingen became angry with Haddon and began chasing him around a car with a knife.

Haddon tried to get away from Swearingen by climbing on top of Swearingen's car.

Swearingen continued to chase Haddon over the top of the car and then stabbed him in the head.
