Man convicted of having sex with woman who fell asleep

JACKSONVILLE, Fla. – A 31-year-old Jacksonville man was recently convicted on one count of sexual battery.

In January 2012, the female victim and a few friends were at Jamie Spivey's house drinking and hanging out. While the victim was asleep, Spivey proceeded to have sex with her without her consent.

Spivey is considered a habitual felony offender, habitual violent felony offender and a prison release reoffender. His previous convictions include burglary and aggravated battery. The crimes occurred in Pinellas and Duval counties.

Spivey now faces 30 years with a minimum-mandatory of 15 years in prison. His sentencing date has not been set.
