JACKSONVILLE, Fla. – One day after being appointed defense lawyer for Michael Dunn's retrial, Waffa Hanania files a motion asking the state attorney's office to turn over any evidence that might contain DNA.
Dunn was convicted last month of four counts related to shooting into the SUV in which 17-year-old Jordan Davis was killed in November 2012, but the jury deadlocked on the murder charge. Dunn testified he felt his life was in danger when he fired 10 shots at the vehicle and claimed self-defense.
His retrial is tentatively scheduled for May, but is expected to be postponed since Judge Russell Healey on Monday allowed defense lawyer Corey Strolla to withdraw from the case.

Dunn, 47, could face at least 60 years in prison on his convictions. Healey is currently deliberating whether his sentencing will be delayed until after the retrial.
In the filing of a Notice of Discovery and Specific Demand for Information, Hanania wrote: "Defendant specifically demands the State provide Defendant with all information it has regarding any physical evidence which either: 1) contains DNA which may exonerate Defendant, or, 2) upon which DNA testing could be performed which may exonerate the defendant.... In addition, Defendant specifically demands the State provide Defendant with all information it has regarding DNA evidence that, if tested and compared to the DNA of Defendant or any other person might mitigate guilt or cause a necessary reduction of the charges filed in this cause."
