In January 2011, Officers found the victim, 35-year-old Spencer Schott, lying face down on the ground in the parking lot of an apartment complex on Beach Boulevard. Schott was transported to a hospital, where he died.

The investigation revealed that the victim and Shepard were involved in a verbal altercation that turned physical, which led to the defendant getting kicked out of Sneakers bar in Jacksonville Beach.

While the victim remained at the bar, he received several text messages and phone calls from Shepard saying that he had gone to the victim's apartment and let his dog out. Schott then returned home.

While the victim was walking in the parking lot, Shepard struck Schott with his vehicle and fled the scene. Shepard was later arrested in Chicago, Illinois.
