JACKSONVILLE, Fla. – A 28-year-old man was sentenced to 45 years in prison after being convicted of second-degree attempted murder, shooting or throwing deadly missiles and possession of a firearm by a convicted felon, state attorneys said.

Antoine Donte Simms was found guilty of the charges in September, authorities said.

Simms and his girlfriend were in the Chick-fil-A drive-thru on Phillips Highway in November 2013 when an altercation happened between him and the victim. State attorneys said the argument began after the victim pulled in front of Simms in the drive-thru line.

Things quickly escalated once Simms pulled out a gun and began shooting at the victim, state attorneys said. Simms and his girlfriend then fled the scene.

The victim was not struck by gunfire, but his vehicle was, authorities said.

State attorneys said Simms was given a 33-year minimum mandatory sentence.
