In June 2010, police found the victim, Sidney Kirksey, lying unresponsive in front of his Ernest Street home near Riverside.

Kirksey was taken to the hospital, but later died of a single gunshot wound to the abdomen.

The investigation revealed that Harvey, who was involved in an ongoing dispute with the Kirksey's family, went to the Kirksey home and shot him.
