Man Tried In Killing Of 20-Year-Old Woman

Two Others Shot In June 2007 Home Invasion

JACKSONVILLE, Fla. – Testimony began Tuesday in the trial of a man accused of killing a 20-year-old woman and injuring another woman and her 6-year-old son.

Marcel Marice Hay is accused of first-degree murder, two counts of attempted murder and four other charges.

Maxine McBride was killed in the triple shooting at a Kendall Court apartment in June 2007. Tiyiesha Dunlap, 26, and her son, Henry Wallace Howard, were wounded.

Hay was gone when police arrived, but was arrested later that day.

In opening statements, prosecutors said Hay confessed after his arrest. Hay's attorney said police coerced the confession because Hay was cold, hungry and police would not provide him a lawyer. Defense attorneys also said Hay's parents will testify that he was home at the time of the crime.

Prosecutors said Hay forced his way into the apartment looking for an ex-girlfriend, Virginia Brooks, who had an injunction against him.

The state's first witness, Brooks testified that she escaped the apartment with her three children before Hay could shoot her.

"I opened the bedroom window and jumped out," Brooks said.

One of the victims testified Tuesday she was asleep in bed next to her son when Hay burst in and shot her.

"I seen, like, fire in front of my face and felt my arm getting warm," Dunlap said. "I looked down and there was blood all over the bed."

Testimony is expected to continue on Wednesday.

Prosecutors said they are not planning to seek the death penalty in the case.
