Beach Diner sues Atlantic Beach over new gas station

Restaurant argues gas station will take away 30 parking spots from diner

ATLANTIC BEACH, Fla. – Beach Diner has filed a lawsuit against the city of Atlantic Beach over the city commission's decision to approve a new Gate gas station.

The station looks to put seven pumps and a 6,400-square-foot convenience store in a small space next to the diner on Atlantic Boulevard.

The owners of the diner argue that the city's approval of the gas station removed 30 parking spaces from the restaurant. The diner is also appealing the commission's decision.
