PALM COAST, Fla. – A Palm Coast man is charged with arson Friday following a DUI arrest, the Flagler County Sheriff’s Office said.

Vitaly Tsabak, 28, was charged with DUI after being found passed out in his car on Columbia Lane, officials said. When police were searching Tsabak’s car, they said they found evidence that linked him to a nearby apartment fire on Fenimore Lane.

Officials responded to the apartment fire after the neighbor of the burning unit called authorities to report a possible break-in at her apartment. During the call, she said she heard a fire alarm coming from next door.

While investigators were still at the fire scene, deputies were called to reports of a man passed out in his car. The person who made the report told deputies that they tried to wake the man up by knocking on the window, but he wouldn’t come to.

Deputies found Tsabak passed out in the driver’s seat when they arrived, and conducted a field sobriety test once they managed to wake him. Tsabal failed the field sobriety test and was arrested for DUI and taken to the Flagler County Inmate Facility, officials said.

Tsabak was arrested for arson while still in jail after the resident of the burned unit gave deputies a list of personal items missing from her apartment that matched the items found they said they found in Tsabak’s car -- including a MacBook with a matching serial number.

Tsabak is charged with arson, burglary, grand theft and possession of burglary tools.
