Florida Supreme Court throws out Thomas Bevel's death sentence

TALLAHASSEE, Fla. – A man sentenced to death for the 2004 murders of a father and his 13-year-old son has been ordered to have a new sentencing hearing. 

The Florida Supreme Court threw out the death sentence for Thomas Bevel.

Prosecutors said Bevel killed Garrick Stringfield after getting into an argument with him over money and then killed Stringfield's 13-year-old son, Phillip Sims, to eliminate a witness.

The jury voted 8-4 for the death penalty. 

The state Supreme Court tossed the death sentence -- not because it wasn't a unanimous verdict -- but because it found Bevel's lawyer provided ineffective counsel during the penalty phase.

Bevel will have a new sentencing hearing.
