A federal appeals court Tuesday rejected arguments by a Death Row inmate that he should receive a new trial in the 1998 shooting deaths of two employees of a car-stereo store in Broward County.
Robert Rimmer, now 49, argued that prosecutors improperly failed to disclose evidence in his case.
Rimmer was convicted in the May 2, 1998, murders of Aaron Knight and Bradley Krause during a robbery at an Audio Logic store in Wilton Manors.
Tuesday's ruling by the 11th U.S Circuit Court of Appeals said the victims were shot “from point blank range in a brutal fashion.”
The appeal involved whether prosecutors withheld evidence by not disclosing reports by the Florida Department of Law Enforcement and the Plantation Police Department.
The federal appeals court, however, backed conclusions by the Florida Supreme Court that the “information contained in the FDLE and Plantation reports was neither exculpatory nor impeaching.”
The appeals court also found that the Florida court “did not unreasonably fail to consider the totality of the circumstances” in denying Rimmer's arguments.
