Convicted rapist wins joint custody of victim's child

The victim's attorney says her client was 12 when the rape occurred

A sex offender has reportedly been granted joint legal custody of a boy he fathered nearly a decade ago when he allegedly raped a 12-year-old girl.

A  Sanilac County, Mich., Circuit judge awarded custody to 27-year-old Christopher Mirasolo after paternity tests found he was the father, the attorney for the boy's 21-year-old mother told The Detroit News.

Attorney Rebecca Kiessling said Mirasolo was 18 when he raped and threatened to kill her client in September 2008, according to that report.

“She, her 13-year-old sister and a friend all slipped out of their house one night to meet a boy and the boy’s older friend, Mirasolo, showed up and asked if they wanted to go for a ride,” Kiessling told the newspaper. “They thought they were going to McDonald’s or somewhere.

Instead, Kiessling said, Mirasolo drove them to a vacant home where he held them captive for two days before setting the older sister free.

Mirasolo, who was arrested a month after the assault, was sentenced to one year in jail for the offense even though guidelines called for a sentence no shorter than 25 years. Then, in March 2010, Mirasolo sexually assaulted another minor -- and received a four-year sentence.

A hearing on the matter is set for Oct. 25.
