Deadly shooting at Clay County Whataburger

FLEMING ISLAND, Fla. – The Clay County Sheriff's Office is investigating a deadly shooting early Thursday morning at the Whataburger on County Road 220 in Fleming Island.

Deputies said Daniel Grady, 22, of Eagle Harbor, was killed. The Sheriff's Office said the shooting happened in the drive-thru lane at 2:05 a.m. and Grady died at the scene.

Police said the shooter, whose name has not been released, was in his vehicle at the drive-thru when Grady approached the vehicle, according to witnesses. An argument occurred for unknown reasons and the shooter, who is an adult Clay County resident, pulled a hand gun and fired at Grady, striking and killing him.

The shooter and his passenger drove home and called the Sheriff's Office, which is investigating the incident. Police said the incident will also be reviewed by the State Attorney's Office.

No arrests have been made.

News4Jax crime and safety analyst Gil Smith said claiming Stand Your Ground depends on how much of a threat Grady might have been to the shooter.

"With Stand Your Grand, you don't have to retreat," Smith said. "You don't have to try to go to a different location or get away from the incident. That will be determined once they look at the entire incident. He may have been within the law to do that, or it just really depends on what they discover in the investigation."

Smith said investigators will determine if the shooter was a legal gun owner and if the gun was registered, as well as dig into what the argument was about.

"I'm sure they will talk with store clerks at the drive thru. Maybe the store clerk heard the argument that was going on between the two," Smith said. "They may even have surveillance video that shows what was going on, how he approached the person."

Whataburger released a statement Thursday about the incident:

"We are so saddened by this sudden and random act of violence and our hearts go out to the family and friends of the victim who are coping with his death. We are working with the Clay County Sheriff's Department to gather details."

Grady was arrested in 2011 for burglary and dealing in stolen property. He served six months in jail and was placed on three years' probation. He did 60 days in jail in 2013 for possession of controlled substances and marijuana.
