Witnesses: Man fired after argument in victim's home

CLAY COUNTY, Fla. – Clay County deputies are investigating a deadly shooting at a Middleburg home just after midnight Saturday.  A man is accused of pulling out a gun and shooting a woman in the head after she slapped him.

Elliot Orsborn, 26, is facing a manslaughter charge in the shooting death of 26-year-old Jamie Martin.

Deputies responded to a 911 call about a shooting at a home on Ashton Street in Middleburg about 12:30 a.m. When deputies got to the home they say they found Martin (pictured) in the garage with a gunshot wound to her forehead. She was taken to Orange Park Medical Center where she was pronounced dead.

After investigating, deputies say they found out Marin lived at the home with her boyfriend, two children and roommate. On Friday night, deputies say Martin had several friends over at her home and was hanging out with them in the garage while her children slept inside the home.

Witnesses told deputies Orsborn had a handgun and kept flashing and playing around with it during the night. Witnesses said at the time the gun was not loaded.

Martin's boyfriend, Gavin Lamberth, told investigators at one point during the night Orsborn said something to Martin, and she jokingly slapped him across the face. That's when he said Martin pulled a silver .22 caliber revolver from his pocket, pointed it at Martin and shot her. Lamberth told deputies Orsborn immediately said he did not mean to shoot her, stayed at the scene for a few minutes then fled. Deputies said they recovered the weapon at the scene.

Clay County investigators took Orsborn  (pictured in Clay County Sheriff's Office booking photo) into custody at his home. He told investigators he wanted an attorney and did not talk with investigators. He was arrested and charged with manslaughter and possession of a firearm by a convicted felon.

Clay County deputies said Orsborn was convicted of aggravated assault with a deadly weapon in January 2011 and also has several drug arrests. 

Orsborn is expected to be in court Sunday morning for his first appearance, where his bond will be set.
