JACKSONVILLE BEACH, Fla. – Lawyers from both sides are now preparing for the trial against the man accused of killing a Jacksonville Beach firefighter and attempting to kill his father-in-law.

Charles Pearce did not appear before a judge Monday during his pretrial hearing, but lawyers did.

Last week, Pearce was ruled competent for prosecution and returned to the Duval County jail. He is charged with first-degree murder in the shooting death of Mike McCue in February 2011.

McCue's twin brother spoke to Channel 4 on Monday about being frustrated with the court system.

"It is a strange occurrence how this whole thing all came together," Mitch McCue said. "There's been all kinds of innuendos and things said, and we don't know. We just want some closure here to get on with out lives. It's hard enough having people come from all over the country and get let down because of zero communication. And it even more hurt being a twin and a twinless twin. It has its own hardships in its own right. So I would hope that no one in this community has to walk the walk that we're walking ever, but I know that's not the case."

Last year, Pearce was ruled not competent and had been remanded to the custody of a Department of Children and Families-run psychiatric care facility.
