According to the Clay County Sheriff's Office, a urine sample test for 60-year-old John Westmoreland was negative.

The Sheriff's Office said Westmoreland had been arrested on probable cause of driving under the influence of alcohol or drugs based on a deputy's observations of him driving and his performance on a field sobriety test.

Westmoreland was pulled over in the 1800 block of Blanding Boulevard near Branan Field Road at about 1 a.m. Sept. 10 after the deputy saw his vehicle swerving in and out of its lane.

According to a police report, Westmoreland blew a .000 twice on the breathalyzer test, but failed the field sobriety test. He then agreed to take the urine test.

The deputy who pulled over Westmoreland wrote in the report the "defendant's eyes were slightly bloodshot and glassy and his face was flushed."

Because the urine test results were negative, the case has been closed.

"As he said from the beginning, John Westmoreland is completely innocent of these charges," Westmoreland's attorney said in a statement Wednesday. "This has been an incredibly stressful time for John and his family. He respectfully asks for his privacy."
