DAYTONA BEACH, Fla. – Sexual battery charges were reinstated on Friday against a former Port Orange police officer.

The Fifth District Court of Appeals reversed a decision to vacate a guilty verdict against Roberto Rosario.

Rosario, 36, was convicted of sexual battery on a helpless person in September 2010.

According to court documents, the judges reversed the order because "the jury verdict finding that Rosario did commit a sexual battery on the victim was not based on an erroneous jury instruction."

Rosario, a former Port Orange police officer, will now face sentencing. He could receive up to 30 years in prison.
