Judge finds tortoise torture suspect not competent

GREEN COVE SPRINGS, Fla. – An 18-year-old woman arrested last year after a video appeared to show her and another teenage girl torturing a tortoise was ruled not competent to stand trial on Tuesday.

Jennifer Greene and Danielle Dionne, 15, posted a video showing the tortoise being lit on fire, thrown on the concrete and being stomped on until it died. The video went viral on Facebook.

Both were charged with felony animal cruelty and causing the death of a gopher tortoise, a misdemeanor.

The judge found found Greene not competent and placed her on a conditional release program.  That means she's getting treatment to restore her competency so she can be prosecuted.

The ruling also applies to a separate charge of lewd and lascivious battery that resulted for sexual activity initiated by a younger teenage boy when Greene was 17.

Greene will be back in court for a review in September.
