Autopsy finds man was killed by his own gun during officer-involved incident: JSO

JACKSONVILLE, Fla. – The Jacksonville Sheriff’s Office on Friday released details and some bodycam footage from the fatal officer-involved-shooting that happened on Jan. 5 at an apartment complex in Bartram Park.

The sheriff’s office said that if Daniel Rodriguez, 34, survived his injuries, he would be charged with attempted murder of a law enforcement officer and aggravated assault on an officer with a firearm.

In the briefing, the sheriff’s office said neighbors at the Luxor Club Apartments on Egrets Nest Drive called 911 about a domestic dispute between Rodriguez and his wife. Residents also said he was holding a handgun at his side.

Officers J. Roderick and J. Milam can be seen speaking with Rodriguez’s wife in the parking lotin the video shared by JSO. She told them that she was arguing with him because she didn’t want him to leave in his car.

While the officers were questioning the woman involved in the incident, Rodriguez emerged near the home. They approached him and asked if he was armed.

The video then showed Rodriguez appearing to lift his shirt and pulling out a .40 caliber handgun from his waistband. The officers then grabbed him and struggled with him for the gun. JSO said that Rodriguez fired one round from his gun, then both officers shot him multiple times.

Officers rendered aid to him until paramedics arrived. He was taken to the hospital where he died, and another handgun was found on him, JSO said.

JSO said the Medical Examiner’s Office conducted the autopsy and saw that he had a contact gunshot wound under his jaw. The bullet from this fatal shot, which was a .40 caliber bullet, was found in his brain. Milam and Roderick both had 9mm handguns and ammunition.

The State Attorney’s Office will conduct its investigation, then JSO will conduct its own to ensure the officers acted within policy.
