Constitutional law expert breaks down birthright citizenship arguments going before Supreme Court

The nation’s highest court, the Supreme Court, will hear oral arguments on Wednesday about the constitutionality of President Donald Trump’s executive order declaring that children born in the U.S. to parents who are in the country illegally or temporarily will no longer be considered American citizens.

Most of the court’s arguments will deal with the history of the 14th Amendment’s citizenship clause.

It makes clear that “all persons born” in the United States who are “subject to the jurisdiction thereof” are citizens.

Constitutional law expert Rod Sullivan joined us on The Morning Show to explain how written arguments from both Trump and the groups challenging the policy focus heavily on what the framers meant by “subject to the jurisdiction” of the United States.
