A Florida judge has upheld his acquittal of a nursing home administrator who had been charged with the overheating deaths of nine patients after 2017’s Hurricane Irma knocked out the facility’s air conditioning.

Prosecutors have dropped manslaughter charges against three nurses who were present when 12 Florida nursing home patients suffered fatal overheating five years ago after Hurricane Irma.

The investigation into the deaths of 12 people at the Rehabilitation Center at Hollywood Hills in Hollywood, Florida, remains "ongoing," said Hollywood Police Chief Chris O'Brien. "The Hollywood Police Department remains diligent in investigating all aspects of this case and additional arrests are anticipated," O'Brien said. Jorge Carballo, the facility administrator, and Sergo Colin, night shift nursing supervisor, were each charged with 12 counts of aggravated manslaughter. David Frankel, a lawyer Colin, emphasized at a Monday news conference that the nursing home staff had reached out for assistance.

FORT LAUDERDALE, Fla. - Four employees of a Broward County nursing home where 12 people died in sweltering heat after a hurricane cut power were charged Monday, at least three of them with aggravated manslaughter, their attorneys said. Nursing home patients at the Rehabilitation Center at Hollywood Hills, ranging in age from 57 to 99, began dying three days after Hurricane Irma swept through in September 2017. Former Rehabilitation Center nurse Sergo Colin and administrator Jorge Carballo were each charged with 12 counts of aggravated manslaughter, according to jail records. Nurse Althia Meggie was charged with two counts of aggravated manslaughter and two counts of tampering with evidence. Memorial spokeswoman Kerting Baldwin said she couldn't confirm that the hospital sent patients to the nursing home.

Rick Scott described as “unfathomable.”The moratorium on admissions, issued by the state Agency for Health Care Administration, came after The Rehabilitation Center at Hollywood Hills was evacuated earlier in the day. U.S. Sen. Bill Nelson, D-Fla., also called on the federal Department of Health and Human Services to get involved in investigating the deaths. Carballo's statement and the moratorium provided more details about what happened at the Hollywood nursing home leading up to the deaths Wednesday. The statement said the nursing home contacted Florida Power & Light and followed up about when repairs would be made. The Florida Health Care Association, a nursing-home industry group, said Wednesday morning that about 150 of nearly 700 nursing facilities in the state did not have electricity fully restored.
