ST. AUGUSTINE, Fla. – A truck driver who said he caught his wife cheating with a co-worker on their anniversary has been charged with aggravated assault after he shot at her and the man in the parking lot of a Flying J truck stop, according to the St. Johns County Sheriff's Office.

Elvin Medina, 57 of Glen St. Mary, was arrested Monday evening after his wife called 911, saying he was shooting at her. According to the wife's frantic 911 call, Medina tried to get her out of the cab of her semi-truck and fired at least two rounds into the cab.

Deputies responding to the 911 call took up positions, one with a rifle in hand, at the exit of the truck stop of State Road 206.

When they spotted the semi-truck that had been identified as belonging to the shooter, they stopped it at gunpoint, and Medina was assisted out of the driver's seat of the rig because he told deputies he was disabled, according to the arrest report.

Deputies said they found a handgun in the truck that appeared to have jammed.

According to the arrest report, there were broken windows in Medina's rig and in the rig parked next to him, indicating Medina fired shots from the cab of the truck.

Medina apologized for the commotion as deputies were taking him into custody, the report said.

“Today is my 13th anniversary with my wife," he told deputies, "and I saw her cheating on me with another man from work.” 

Medina was charged with aggravated assault with a deadly weapon without intent to kill and shooting into a vehicle. Both are felonies.

In an interview with deputies, Medina's wife, who is also a truck driver, admitted to having an affair with a co-worker and said she and the other man were driving separate loads and both stopped at the Flying J, which is where Medina found them.
