According to State Attorney Melissa Nelson, the victim and the 2-year-old son she shared with Miller moved into an apartment with Miller and Miller’s current girlfriend in Orange Park in December 2020.
On Dec. 21, 2020, Miller and the victim took what was supposed to be a day trip to Orlando, but that evening Miller returned to the apartment without the victim, prosecutors said.
Four days later, the victim returned to the apartment to get her son, which sparked an argument that became physical.
During the fight, Miller got a handgun and pointed it at the victim as she held their son and told her that she was not taking their child.
As she walked out, Miller followed her — still with the gun — and took the son from her and went back inside the apartment.
The victim returned inside to retrieve the child, and the argument continued, with the victim slapping Miller at one point.
He then shot her three times, and the victim died at the scene. She was not armed when Miller shot her.
The case was investigated by the Clay County Sheriff’s Office and prosecuted by Assistant State Attorneys Ashley Terry and Cara Devlin.
