Attorneys for a Tennessee death row inmate say they are concerned the state may be planning to use expired lethal injection drugs at a planned execution on Thursday.

Tennessee has executed Oscar Smith for the 1989 murder of his estranged wife, Judith Smith, and her sons, Jason and Chad Burnett.

Tennessee Gov. Bill Lee is declining to provide any new information surrounding why they had to call off the state’s first execution since the pandemic began.
