Atkins was shot outside a closed Westside day care on Sept. 12 and later died at the hospital.

Atkins' family said police told his mother that they suspect the shooting that killed Atkins was accidental, but the family wanted charges filed.

Atkins was dropped off at a fire station near Melvin and Ricker roads with a gunshot wound, said Sgt. Mark Musser with the Jacksonville Sheriff's Office. He did not survive.

Musser said Atkins was shot behind a closed day care near Indian Lakes Drive and Ricker Road. Three minors were brought in for questioning after flagging down a passerby to take Atkins to the fire station.

Ashley was arrested Friday at Jefferson Davis Middle School on Burma Road in Jacksonville.

Police said no one else has been arrested in the case.
